SR22 Insurance Filing in Illinois



Illinois SR22 insurance, also known as Financial Responsibility Insurance, is a service that was created to watch the insurance of troubled vehicle operators. The service also allows the Illinois Secretary of State's office to put a suspension upon the license when there is a cancellation or expiration of the SR22. The SR22, Financial Responsibility, insurance is also mandated in Illinois for people with safety responsibility suspensions, unsatisfied financial judgment suspensions, revocations, compulsory insurance supervisions and persons who get more than two convictions for compulsory insurance violations. 



To get an SR22, people have to contact an insurance carrier permitted to offer SR22 insurance contracts  in the State of Illinois.  The SR22 policy must be produced on a Financial Responsibility Certificate from the main headquarters of the insurer. 

SR22 Insurance Forms

 

The SR22 certificates are produced  in one of the following forms:


Operator's Certificate -  This certificate covers the motorist in the operation of any non-owned vehicle. Clients who are issued this certificate are not covered under vehicles they own.
Owner's Certificate - This insurance certificate covers autos owned by the insured person. The vehicle's year, make and model must be scheduled on the SR-22 certificate or may be issued for all owned vehicles.
Operators-Owners Certificate - This contracts covers all owned and non owned autos of the insured person.


When insurance premium is paid to an insurance agency, the agency will submit a request for an SR22 certification to the main headquarters of the auto insurer. The SR22 certificate is  then sent (electronically or by mail) directly to the Illinois Secretary of State's office and may take up to 30 days for processing. Electronic processing takes less time. The insured person will get a copy of the SR-22 from the insurance carrier and a letter from the Secretary of State's office. The SR22 insurance filing must be kept in tact for 3 years. If the SR22 expires or is cancelled, the insurer is mandated by law to inform the Safety and Financial Responsibility Section by submitting  an SR26 Certificate, or Cancellation Certificate. Upon receipt, the driving license of the SR22 insurance holder will be suspended.

This suspension cannot be removed until the insurance filing has been reinstated.


SR22 insurance certificates should be renewed at least 45 days in advance to avoid future insurance-related suspensions.

SR22 Insurance Alternatives


Instead of getting an SR22 insurance certificate, an individual may do one of the following:

​

1. Deposit $55,000 in cash or securities with the Illinois State Treasurer,

​

(2) file a surety bond, or

​

(3) file a real estate bond approved by a court of record.

​

For out-of-state residents who are required to fille SR22, they may request their proof of financial responsibility for Illinois be waived by completing an Affidavit. The affidavit is relevant only to Illinois' insurance mandates. For operators who move back to Illinois within 3 years from acceptance of the insurance waiver, the SR-22 requirement for Illinois would be renewed as well.
